1. Acceptance of Terms

By accessing or using ubeen.to ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legal agreement between you and Ubeen Studios LLC ("we", "us", or "our").

2. Description of Service

ubeen.to is a travel discovery platform that provides AI-assisted and community-created city guides. The Service includes browsing free city guides, creating and publishing your own guides, bookmarking cities, rating guides, and accessing premium content through a subscription or credit-based system.

3. Eligibility

You must be at least 13 years of age to create an account and use the Service. If you are between 13 and 18 years of age, you must have parental or guardian consent to use the Service.

4. Accounts

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.

5. User-Generated Content

You retain ownership of the travel guides and content you create on the Service. By publishing a guide, you grant Ubeen Studios LLC a non-exclusive, royalty-free, worldwide license to display, distribute, and promote that content within the Service.

You are solely responsible for the accuracy and legality of the content you publish. You agree not to post content that is false, defamatory, infringing, obscene, or otherwise unlawful.

6. Credits and Subscriptions

Certain features, including AI-assisted guide generation, require credits or an active subscription. Credits are non-refundable and have no cash value. Subscription payments are processed through third-party payment providers. Subscriptions renew automatically unless cancelled before the end of the current billing period. All purchases are subject to the refund policies of the respective payment provider.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Scrape, crawl, or harvest content from the Service in bulk without written permission
• Attempt to gain unauthorized access to any part of the Service or its infrastructure
• Interfere with or disrupt the Service or its infrastructure
• Create fake reviews, ratings, or guides intended to mislead users
• Redistribute, sublicense, or resell access to the Service or its content

8. Intellectual Property

The Service, including its design, code, graphics, and non-user-generated content, is the property of Ubeen Studios LLC and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers ownership of our intellectual property to you.

9. Travel Information Disclaimer

Travel guides on the Service, including AI-generated content, are provided for informational purposes only. Information such as visa requirements, safety conditions, and costs of living may change without notice. We do not guarantee the accuracy, completeness, or timeliness of any travel information. Always verify critical travel information through official government and embassy sources before making travel decisions.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Ubeen Studios LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. Our total liability for any claim arising from these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive, including ownership, warranty disclaimers, and limitations of liability.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated revision date. Your continued use of the Service after the posting of changes constitutes your acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Bernalillo County, New Mexico.
